Custom butchering and wholesale services are provided based on individual agreements. Specific terms, including pricing, delivery schedules, and minimum quantities, will be confirmed in writing at the time of engagement.
5. Pricing and Payment
All prices are quoted in Australian dollars (AUD) and include GST unless stated otherwise. Prices are subject to change without notice, but we will honour the price confirmed at the time of order.
Payment terms are as follows:
- Retail customers — payment is due at the time of order unless otherwise agreed.
- Wholesale and trade customers — payment terms are specified in your supply agreement. Standard terms are net 14 days from invoice date.
We reserve the right to charge interest on overdue amounts at the rate prescribed by the Penalty Interest Rates Act 1983 (Vic).
6. Delivery and Risk
We deliver to addresses within Victoria. Delivery times are estimates only and we are not liable for delays caused by circumstances beyond our reasonable control, including adverse weather, road conditions, or carrier disruptions.
Risk in the products passes to you upon delivery. You should inspect all goods upon receipt and notify us within 24 hours of any damage, quality issues, or discrepancies.
7. Returns and Refunds
Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits or excludes your rights under the ACL. If a product is faulty or does not meet acceptable quality standards, please contact us and we will assess the issue and provide a remedy in accordance with the ACL.
8. Limitation of Liability
To the maximum extent permitted by law, Cold Cuts Butcher Pty Ltd’s total liability to you for any claim arising out of or in connection with these Terms, the website, or the supply of products and services is limited to:
- the amount paid by you to us in the 12 months preceding the claim; or
- re-supply of the products or services, at our election.
We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or business opportunity, whether arising in contract, tort (including negligence), or otherwise.
